Dear legal world, I am desperately reaching out for any help or assistance dealing with my appeal. I am presently being incarcerated under a illegal sentence. I am not legal savvy, and do not have the finances or recourses to hire an attorney to rectify the plain error.
In short, I was sentenced to 10 years on both charges of aggravated robbery and kidnapping with both charges carrying a R.V.O. (Repeat Violent Offender) specification. I was sentenced to 10 years on bot R.V.O.'s. Stated under Ohio's R.C. 2929.14(B)(2)(b)(iii), a court shall impose longest prison term authorized on felony offense to be able to impose a R.V.O. spec. Please view for yourself, (State v. Petti, 2012-Ohio-1453)!!! The maximum sentence on both first degree felony charges of aggravated robbery and kidnapping is 11 years. Where I was only sentenced to 10 years. The court is without the authority to act to impose a R.V.O. specification sentence without imposing the maximum sentence on the underlining conviction.
Crimes are statutory, as are the penalties therefore, and the only sentence that a trial judge may impose is that provided for statute. I am also presently undergoing a major issue here within Mansfield Correctional Institution where my civil rights are bring violated. It is impossible for me to work on this winning issue if I wanted to. It is imperative that I get some outside help. The mail room has declined and confiscated my legal mail directly from the Clerk of Courts without me even viewing it or being present while they opened it.
It would mean the world to me if somebody having knowledge to assist me would come to my aid. Yes, I have made some terrible mistakes in life, but I'm not a bad person. I am humbly paying my dues, while constantly bettering myself spiritually and mentally. I was found guilty at a jury trial for putting my brother in law in the trunk of a car and sentenced to 25 years. Where If I would of taken the plea bargain, I would've got 6 years.
