Greetings brothers and sisters of the free world.
My name is David. I am 62 years old and have been in prison for 43 years, since I was 19. It is time that I get out of this place, but I will need help to accomplish this.
I am a guitar player, singer, songwriter. I am a member of the Catholic choir. I have a bachelor’s Degree from Boston University. When lifers were able to be in minimum security prisons I worked at 3 State hospitals as a mental health assistant volunteer. I also received 11 furloughs. All of this is now gone due to politics.
I am writing this as a plea for legal assistance and prayers. Trying to receive freedom, as a lifer, in Massachusetts through a commutation is a fallacy. No matter what one has done in the past or present to better themselves, the answer is no! My only avenue for freedom is through the court system, legally.
In 1975 after a 2-day trial, I was convicted on hearsay evidence. Now, by myself, I’m trying to seek relief through the courts with a post-conviction new trial motion.
In 2013, I filed that motion in a lower court. The commonwealth never filed an opposition brief. Four years later that motion was denied by a superior court judge. This is common practice, because they would rather leave it up to the Appeals court. That judge would not grant me an attorney, denying all motions.
I am still in that lower court because I decided to add supplemental motion incorporating other issues to the original motion to be heard before the state supreme court. All of these issues have never been brought before a court. I believe that they hold serious merit.
As soon as this supplemental motion is decided, I am going to need an appeals attorney to put my appeal together for me. I do not have the knowledge to do this. Everything done so far was done with the assistance of another inmate. He has suddenly decided to stop doing legal work, leaving me in a difficult position. If I don’t get these issues into the appeals court within a limited time, after my lower court decision, I will lose the chance to ever bring these wrongs before a court.
So, I am asking anyone that can help me, please consider this. An appeals attorney familiar with Massachusetts appeals system would be a God send.
I consider myself a good person, and will make anyone proud of me, should they decide to help me in my endeavors for my freedom. I have a strong desire to give back to the community, to atone for my wrongs as a troubled youth. My intentions are honorable. I don’t believe in breaking hearts or letting people down, if I can help it.
I am leaving it in God’s hands and hope that he is the divine being that is influencing me to do this.
