Stephen Telemaque #06215-104

Picture 1 of 1

I am writing to request your help and assistance in any manner you can provide to me. If you are unable to assist me, would you please provide me names and numbers of lawyers willing to represent me on a pro bono basis? I have been in Federal prison for six (6) years now and have little to no money.

I am requesting help with my Federal case. I am actually innocent as the facts of my case show clearly that I was convicted of a non-crime, i.e., the substance was not listed as a controlled substance under Federal law at the time of my offense. This was demonstrated in the United States Court of Appeals for the Eleventh Circuit case, United States v. Phifer, 909 F.3d 372 (11th Cir.2018). My case is similar to the Phifer case in substance. See, United States v. Telemaque, No. 1:15-cr-20531 (S.D. FL. 2016).

I have pursued a direct appeal (conviction and sentence affirmed); a motion to vacate, set aside, or correct a sentence pursuant to 28 U.S.C. 2255, that was denied before the court even considered the merits. An application for a Certificate of Appealability to the Eleventh Circuit as to the denial of the 2255 motion, which was also denied. I filed a motion to void judgment of denial on my 2255 motion pursuant to Rule 60(b) of the Federal Rules of Civil procedure, which was also denied. This was followed by an appeal of the 60(b) motion to the Eleventh Circuit, which was also denied. Finally I petitioned the United States District for the Eastern District of Kentucky for the writ of habeas corpus on my claim of actual innocence, that was denied. This was followed by appeal of the denial of my habeas corpus petition to the United States Court of Appeals for the Sixth Circuit, which was also denied. All my filings were done pro se.

I have no legal background or education. I do not know what I am doing wrong or how to go about getting my unlawful conviction overturned. I am diligently pursuing my rights, but I am at a loss as to why I am continuously being denied relief. I am in desperate need of your help, please.

Thank you for your time and consideration with this matter, I cannot express how much I greatly appreciate any help you can provide. If you are willing to provide an email address so that I can send you a Corrlinks invitation it will ease communication on both our ends. I look forward to your prompt response. Until then, I remain,

Respectfully yours,

Stephen Telemaque
