I have a pp that was convicted of hurting people (physically). He has done now some years, and he will get a hearing, cause during this trial his rights were not honoured (the judge sent part of his family home during trial).
But, and this is what I do not understand, maybe I am too Belgian. He expects to get a new trial out of this hearing. I do not understand what he wants out of this new trial. The reason why he is incarcerated doesn't change, so I suppose that he will be convicted again for about 20 years? But he expects to come out in 18 months after that new trial???? Is the crime changing only because his rights were violated?
OK, I am Belgian, and I know nothing about the US-law system, but I do not see any good point in it for him???

In this country, indivdual rights to a fair trial is protect under our constitution. And yes, a previous sentence can be overturned...and often is if the circumstance's proves right. Gd4or
