Hi everyone :)

Well, my new PP says he´s serving 21 years for 2º degree murder (commited when he was a teen).
Is that possible? I´m not american so i´m still kinda ignorant about law there but i usually see profiles of people serving life for murder...Is he saying the truth?

Hi yes it is possible not all recieve life or death penalty it all depends on circumstances which state he is in etc etc.

2nd degree murder can also carry a 16 year sentence. Yes, he is likely telling the truth. Capital murder (also can be 1st degree too can carry life sentence) is usually a life-sentence or death penalty, not 2nd degree.

With California it really depends on the sentencing county. Each one is drastically different. For instance: In Santa Clara County California (A fairly liberal county), you could get a 3 to 5 year sentence for car theft, but stealing the very same car in a county like Amador County, which is far more conservative, and get a 10 to 12 year sentence. The sentencing guidelines in California have very little standardization, and the county prosecutors and judges have huge leeway. Sad, but true.
