If someone is saying nasty stuff in letters like "i hope they fry your ass,"
are the inmates protected in any way? thats probably a dumb question,
if they get hate mail can they take legal action?
I think just because you are incarcerated does not give you any less rights than a person on the outside, the mail room should censor/screen the mail as we all know they do and grant you the same legal protection as you would get for yourself if you were on the outside, by the same token they should tell the inmate they have some distressing mail does he want to see it and then its up to him/her to suggest what action they would like taken.

Honestly, most of the time the letters are not really read. If the inmate is in an anti-gang program or a gang member or a part of an STG group they will read and/or scan them in.
The inmate CAN do something about them. They have to take the first step. Most just throw it away.
When someone was sending Junior unwanted mail his lawyer got involved and informed the sender that legal action could be taken. The letters stopped immediately.
The inmate can also ask the mail room to place mail from unwanted persons to be placed on a blocked list, and the mail will not even reach the offender.

Peanut and Skye are right . Usually it will just get flushed . The sender thought of as an idiot or nutcase .
If there is a pattern or threats The prisoner can take legal action in a number of forms. If the person does notstop it at minimum is harassment of some form
If the person appears to be psychologically unstable the state can intervene in a number of ways from a psychiatric hold and evaluation to criminal charges and being detained for a forensic psych evaluation depending on the situation .
Both have happened on more than occasion It is never a good idea to send any thing threatening however vague to any one in any form .
Hate mail/ E mail and speach can get the attention of authorities very quickly no matter who the receiving party is . Post 9/11 and shooting rampages in the past 10 or so years things like that are taken much more seriously.
